All the talk coming out of Washington DC lately is about regulation. The refrain is to regulate Wall Street to avoid future melt downs of the market. Well this week we find out that the regulators who were supposed to be watching over the financial markets were too busy watching PORN to be paying attention to their regulatory responsibilities. They were looking at peep shows rather than looking over financial reports. Granted financial statements can be rather dull but according to one report some of these SEC officials were getting paid quite handsomely to do this job. And you know what I did not hear one peep out of OBAMA or his clan to cap these top officials salaries. I wonder if they still have their jobs?

Seventeen of the employees were “at a senior level,” earning salaries of up to $222,418.

What did the White House propose instead? You guessed it more regulation and more responsibility for the SEC. I wonder who they are going to hire to see that the work gets done? Who is going to be watching the regulators? The truth of the matter is had Goldman Sachs been allowed to fail we would not even be having this discussion. We the people said “no to bailouts”, but the government decided to bail them out anyway, and from the sounds of the new regulatory bill they plan to do so into the far distant future.

A hired hand isn’t a shepherd and doesn’t own the sheep. When he sees a wolf coming, he abandons the sheep and quickly runs away. So the wolf drags the sheep away and scatters the flock. The hired hand is concerned about what he’s going to get paid and not about the sheep. John 10:12-13 (GW)

The sound of the word REGULATION gives a sense of safety. It makes people think there are people paid to keep an eye on certain industries and practices to make sure they operate within the law. But it turns out that those who are paid to keep watch are watching something else. These are hired hands, employees paid to be there, they have no vested interest in the people nor the families they are supposed to be looking out for. They are merely getting paid to do a job and when something bad happens they are quick to push the blame elsewhere. They have no concern over the well being of someone living hundreds or perhaps thousands of miles away. The halls of the government are cold and hollow.

Take for example the recent WV mining accident to see how well Government Regulation worked out.

On April 5, 2010, the community of Montcoal, West Virginia was devastated when an explosion at the Upper Big Branch mine took the lives of 29 men. Not only does the tragedy of Upper Big Branch demonstrate the inadequacy of regulations alone to protect vulnerable workers and their families, it highlights the vital importance of our nation’s civil justice system as a means of compensating victims and punishing those whose reckless conduct harms others.

According to the New York Times, “the mine had been cited for hundreds of violations over the last year, including many serious ones.”

Why then, did the mine continue to operate?

In order to avoid steep fines and delay the need for compliance, the Massey Energy Company fostered bureaucratic gridlock by contesting most of the Upper Big Branch mine’s safety violations. While regulatory officials at the Mine Safety and Health Administration

(MSHA) waded through stacks of appeal documents, hamstrung by weaknesses in the 1977 Mine Safety Act, the mine continued to operate unimpeded.

The very nature of bureaucracy is to generate paperwork. Remember a government large enough to regulate even the very air we breath is too large to operate efficiently and timely in any matter. The best you can hope for from any government agency is they will get around to it eventually. Eventually was too late for 29 miners in West Virginia.

What’s more, the mining industry (as with many other regulated industries) has long had a revolving door between the regulators and the regulated. The ranks of the regulators are often filled with folks who come out of the mining industry. Likewise, the industry provides opportunities for advancement for regulators who decide to leave government service. This calls into question the zeal with which some regulators carry out their duties. Does a regulator really want to get tough on the company that might provide him with his next job?

In other words we have the fox watching the hen house, and to make matters worse, the companies hire back these “foxes” so they have an insider on the payroll. This is actually a good idea if you want to scam the system, which is exactly what happens where there is too much government regulation. Companies find ways around the regulations which then renders the regulations mute.

Of course, regulatory regimes do nothing to compensate the victims or their families for the damages they suffer in such catastrophes. The fines that errant corporations pay for violating government regulations go to government, not the victims of those violations.

This perhaps is the biggest reason the government loves regulation, they are the ones benefiting by enforcement of the regulations. But as you can see the regulations do not hinder the operations of those who are being regulated, regulation therefore becomes nothing more than another tax. It is a “pay to play” program set up by the government, with the pretense of actually being watchdogs. In reality all they are doing is designing rules by which the companies can operate legally, thereby putting a stamp of legitimacy upon an otherwise illegitimate operation. And to justify their existence they pass more and more regulations, which require more oversight, and the perpetual motion machine never stops.

Why then was there a financial crisis on Wall Street? Was it due to Goldman Sachs and others not being properly regulated? No it was because they “paid to play” and the regulators looked the other way. Through massive lobbying efforts and large campaign contributions, lawmakers can be bought and paid for. Companies find it is cheaper to pay off the regulators than to actually comply with the regulations. Therefore the regulators and the companies form an unholy alliance, whereby the government agrees that they meet all regulatory standards, and the company operates with the governments approval, until someone dies. Or the markets crash, or an airplane falls out of the sky, or you fill in the blank.

Therefore the fault lies right at the feet of the government regulatory system. The next time you hear another politician say there is not enough regulation remember the families of the Upper Big Branch mining disaster, government regulation did absolutely nothing for them. Nor will it. You can not sue the federal government even though that is exactly where the buck should stop. If the Mine Safety and Health administration was doing their job then Upper Big Branch mine would have been shut down until they were in compliance. Government regulation cost 29 men their lives. How safe do you feel now?

The Unprecedented President

Wednesday evening President Barack Obama will give his State of the Union address. An address he hopes will change his sinking poll numbers and pull his unprecedented Presidency out of the free fall it currently finds itself in. This unprecedented President has fallen so fast that is it well unprecedented. This latest achievement can be added to his other unprecedented accomplishments since taking office a year ago. Let us take a look at a few shall we?

2009 started out with the unprecedented election of the first non-white President of these United States. There in fact are some who would argue he is the unprecedented undocumented President to occupy the White House. His election was reported as ‘historic‘. Surely it was unprecedented in the amount of money spent on his campaign.

Perhaps it was a sign when President Barack Obama sat down in January to record his first weekly address and announced:

“We begin this year and this administration in the midst of an unprecedented crisis that calls for unprecedented action.”

What has followed is declaration after declaration of “unprecedented” milestones.

Unprecedented taxing of anything that moves and if it keeps moving tax it even more

Unprecedented lack of knowledge concerning foreign and domestic policies

Unprecedented lack of credentials no birth certificate or actual executive experience. Did he ever really hold a real job?

Unprecedented granting of Constitutional rights to enemy combatants while simultaneously taking them away from actual American Citizens.

Unprecedented nepotism and cronyism when handing out government jobs and taxpayer money.

Unprecedented SPEED in passing 1000+ paged bills without even having read them and at the same time taking almost 9 months to decide what help to provide our Armed forces serving in Afghanistan

Unprecedented number of times and places where this President apologizes to foreign nations for the HORRORS of America

Unprecedented number of times he promotes Islam as a PEACEFUL religion while at the same time his administration demonizes Christians and grass roots Americans calling them TERRORISTS and a THREAT to this Nation.

Unprecedented appointment of Czars.

Unprecedented number of appearances on Sunday night televisions news programs.

Unprecedented number of televised speeches delivered during his first 100 days. Totally 411 for the year. And yet he says America had not heard his message.

Yes indeed we have an unprecedented President.

You Can Praise Him but DO NOT Oppose Him


The one was on the air again last night giving yet another speech on his plans to socialize as much of America as possible. When one freshman congressman had about all he could stand he blurted out: “you lie” and the attacks came fast and furious.

No the attacks were not focused on the “LIAR” but on the one who outed him. Rep. Wilson who was sent to Washington D.C. to be the voice of his constituency back home was only saying what so many of us were yelling at the top of our lungs as well. “YOU LIE” in fact the whole speech was full of misleading and false statements. One thing was clear though, if you want to give his highness a STANDING OVATION you are more than welcome to interrupt him, but DO NOT, I REPEAT, DO not oppose ‘the one’ because that will not be tolerated in the hallowed halls of the joint house.

Rep. Wilson you need not apologize to anyone for me. In fact I want to stand and applaud you for standing up and saying what we back home have been saying for months. And now to the rest of you in the house, perhaps you all should apologize to your constituents who put you there to fight for US and not apologize to ‘the one’ who wants to pick a fight with us.

I am greatly distressed by the SILENCE of our representatives who are not speaking on our behalf. Instead you simply nod and keep still while this President continues to deride, degrade, berate, and ridicule America, while he attempts to remake America into a socialist style government. You, our elected representatives were sent to Washington to protect our interets and not sell us out to the self-anointed one.

President Obama and every representative who voted for his phoney stimulus bill, his failed bailout bills and his porkulus spending bill OWE AMERICA a HUGE apology. In fact they would do us all a favor by simply resigning.

Rep. Joe Wilson is apologizing for blurting out “You lie!” during President Obama’s nationally televised address Wednesday night — but he’s not backing down one bit about Obama being wrong in saying healthcare reform won’t subsidize insurance for illegals.
“This evening I let my emotions get the best of me when listening to the President’s remarks regarding the coverage of illegal immigrants in the healthcare bill,” the South Carolina Republican said in a statement issued shortly after the president’s speech to a joint session of Congress ended. “While I disagree with the President’s statement, my comments were inappropriate and regrettable. I extend sincere apologies to the president for this lack of civility.”
Reaction to Wilson’s outburst came fast and furious. Republicans distanced themselves from the breach of protocol — Sen. John McCain of Arizona decried it
and House Democrats actually called for Wilson to be censored.

Would you Believe? Liar In Chief Strikes Again


This comes from an AP story which up to now has mostly been in the tank for Obama. However even a stopped clock is right twice a day so here is one of those times even AP got it right.

AP FACT CHECK from the OBAMA speech on July 22, 2009 in an article titled:

FACT CHECK: Obama’s health care claims adrift?

WASHINGTON – President Barack Obama’s assertion Wednesday that government will stay out of health care decisions in an overhauled system is hard to square with the proposals coming out of Congress and with his own rhetoric.

Even now, nearly half the costs of health care in the U.S. are paid for by government at all levels. Federal authority would only grow under any proposal in play.

A look at some of Obama’s claims in his prime-time news conference:

OBAMA: “We already have rough agreement” on some aspects of what a health care overhaul should involve, and one is: “It will keep government out of health care decisions, giving you the option to keep your insurance if you’re happy with it.”

THE FACTS: In House legislation, a commission appointed by the government would determine what is and isn’t covered by insurance plans offered in a new purchasing pool, including a plan sponsored by the government. The bill also holds out the possibility that, over time, those standards could be imposed on all private insurance plans, not just the ones in the pool.

Indeed, Obama went on to lay out other principles of reform that plainly show the government making key decisions in health care. He said insurance companies would be barred from dropping coverage when someone gets too sick, limits would be set on out-of-pocket expenses, and preventive care such as checkups and mammograms would be covered.

It’s true that people would not be forced to give up a private plan and go with a public one. The question is whether all of those private plans would still be in place if the government entered the marketplace in a bigger way.

He addressed some of the nuances under questioning. “Can I guarantee that there are going to be no changes in the health care delivery system?” he said. “No. The whole point of this is to try to encourage changes that work for the American people and make them healthier.”

He acknowledged then that the “government already is making some of these decisions.”

OBAMA: “I have also pledged that health insurance reform will not add to our deficit over the next decade, and I mean it.”

THE FACTS: The president has said repeatedly that he wants “deficit-neutral” health care legislation, meaning that every dollar increase in cost is met with a dollar of new revenue or a dollar of savings. But some things are more neutral than others. White House Budget Director Peter Orszag told reporters this week that the promise does not apply to proposed spending of about $245 billion over the next decade to increase fees for doctors serving Medicare patients. Democrats and the Obama administration argue that the extra payment, designed to prevent a scheduled cut of about 21 percent in doctor fees, already was part of the administration’s policy, with or without a health care overhaul.

Beyond that, budget experts have warned about various accounting gimmicks that can mask true burdens on the deficit. The bipartisan Committee for a Responsible Federal Budget lists a variety of them, including back-loading the heaviest costs at the end of the 10-year period and beyond.

OBAMA: “You haven’t seen me out there blaming the Republicans.”

THE FACTS: Obama did so in his opening statement, saying, “I’ve heard that one Republican strategist told his party that even though they may want to compromise, it’s better politics to ‘go for the kill.’ Another Republican senator said that defeating health reform is about ‘breaking’ me.”

OBAMA: “I don’t know, not having been there and not seeing all the facts, what role race played in that. But I think it’s fair to say, number one, any of us would be pretty angry; number two, that the Cambridge police acted stupidly in arresting somebody when there was already proof that they were in their own home, and, number three, what I think we know separate and apart from this incident is that there’s a long history in this country of African-Americans and Latinos being stopped by law enforcement disproportionately.”

THE FACTS: The facts are in dispute between black scholar Henry Louis Gates Jr. and the white police sergeant who arrested him at his Cambridge, Mass., home when officers went there to investigate a reported break-in. But this much is clear: Gates wasn’t arrested for being in his own home, as Obama implies, but for allegedly being belligerent when the sergeant demanded his identification. The president did mention that the professor was charged with disorderly conduct. Charges were dropped.

OBAMA: “If we had done nothing, if you had the same old budget as opposed to the changes we made in our budget, you’d have a $9.3 trillion deficit over the next 10 years. Because of the changes we’ve made, it’s going to be $7.1 trillion.”

THE FACTS: Obama’s numbers are based on figures compiled by his own budget office. But they rely on assumptions about economic growth that some economists find too optimistic. The nonpartisan Congressional Budget Office, in its own analysis of the president’s budget numbers, concluded that the cumulative deficit over the next decade would be $9.1 trillion.
